Court tomorrow

March 22, 2011

Court is supposed to be tomorrow. The birth mother is supposed to be giving consent. If that happens, as it is supposed to, the process should be done by the end of April.

I found out that small steps forward were taken yesterday in court.

BM’s lawyer wanted to change a few things in the consent agreement. Apparently there were some concerns about access with other biological children. BM thought this was promised, and isn’t happening. Since this experience is very similar to the experience with the last family, it is very easy to imagine that they have no interest because of the difficulties they experienced.

We have committed to access a couple of times a year, we’ll see how it goes.

They want to meet with us, and BM wants to have some access again. There will be a couple of visits, likely no more than an hour.

The meeting is scheduled for March 4, barring any conflicts or last minute cancellations.

Court is adjourned until March 22. The sitting judge wanted the case to come back before her, and that is when she is on the bench again.

The end is coming. Not very quickly, but it is coming.

Maybe consent?

Today I spoke with the worker who attended court yesterday.

She told me that the case was adjourned only for one week, because of BM’s illness.

BM’s lawyer actually said she would like to see a resolution 🙂 so perhaps the cynical view she is all about billable hours could be over.  Or, legal aid is cutting her off.  Who knows.

The worker is drafting up a consent package for BM to sign at court next week.  BM would like to have another meeting with us, just to make sure access is available at some point in the future.  We have said many times that we will provide letters, pictures, and a couple of meetings a year.

The worker was pretty confident that everything should be resolved within a couple of weeks.  This is a hopeful sign, but we’ll see.

We may have a couple of more visits.

Once consent is obtained, there will be one more good-bye visit, and life can go on as normal.

I spoke with one of our workers today and got some more information about the next steps.

A settlement conference is a meeting between the agency’s lawyer, BM’s lawyer, BM, and the family service worker. They will discuss where things are at and what it will take to resolve things.

Our workers are still working, even though we haven’t heard much lately.

Still no word on visits. Likely will happen again, no matter how annoying. It’s still part of the process.
